What the Aged Care Act 2024 Means for You & Your Loved Ones

Overview: What is the Aged Care Act 2024?

Australia’s Aged Care Act 2024 is the new federal law that governs government-funded aged care. It replaces the Aged Care Act 1997, responding to the Royal Commission’s call for a rights-based system centred on older people. The Bill passed Parliament in November 2024, received Royal Assent on 2 December 2024, and commences on 1 November 2025 (aligned with the Support at Home program).

Key changes at a glance

1) Rights & responsibilities

  • A formal Statement of Rights sets out what older people can expect in care (dignity, safety, choice, culturally safe care, complaint handling). Providers must uphold these rights and will be regulated against them.

2) A clearer regulatory framework

3) Funding & programs

  • The Act underpins reforms to home care (the new Support at Home model) and residential care, with a roadmap guiding sector transition to the 1 Nov 2025 start. 4) Transparency & accountability

  • Greater emphasis on provider governance, quality standards and accessible information for consumers to compare services.

Home care vs residential care: what changes for families?

  • Home care (Support at Home): Designed to simplify and better target supports delivered at home—combining help like  personal care, domestic assistance, therapy, equipment and home modifications into a clearer model, with rights front-and-centre.

  • Residential aged care: Continues under the new Act with strengthened standards, clearer rights, and improved oversight of provider duties and reporting.

Sydney tip: If you’re already receiving Home Care Packages or residential care, your services continue. Providers will update agreements to reflect the new rights and rules before 1 Nov 2025

Timeline: when changes take effect

  • 25 Nov 2024: Parliament passes the Aged Care Bill 2024.

  • 2 Dec 2024: Royal Assent—becomes the Aged Care Act 2024.

  • Now → Oct 2025: Transition period; government releases guides, amendments and the reform roadmap.

  • 1 Nov 2025: Act commences; new framework and Support at Home start.

What families should do now (Sydney checklist)

  1. Know your rights: Read the plain-language guides and note the Statement of Rights.

  2. Review care plans: Ask your provider how your home-care or residential agreement will be updated before 1 Nov 2025.

  3. Budget & services: Request a simple breakdown of services, fees and any changes under Support at Home (if you’re at home).

  4. Keep documents handy: ID, Medicare, GP details, medication lists, Enduring Power of Attorney/Guardianship if applicable.

  5. Book assessments early: If starting services, arrange a My Aged Care assessment and ask about interim supports while you wait.

What providers should do

  • Map obligations to the Statement of Rights and updated Quality Standards; brief staff and update policies.

  • Follow the roadmap: diarise milestones and training before 1 Nov 2025

  • Update agreements & communications: provide clear, plain-English information to consumers about changes.
